I think the point of focus in the shot of the guy in the boxing stance needs to be his face.
I'm trying to remember a similar pose by Bruce Lee and where the focus was. Isn't the fist where the action is? (but yeah, I too expected the face to be in focus)

Like many others we have been waiting for our AOS application to be approved for over 2 years. But the strange thing is, I did get an EAD approved but they never called me in for fingerprinting and Biometrics. I know I had to do the non-immigration "registration" that was initiated a few years ago and they had taken my fingerprints and biometrics, is that why they didn't call me in again? since they already have it?
I had to get the fingerprints and retinal scan the last time I went out of the country and had to get the visa stamping done. But I don't think it was termed as non-immigrant "registration".
Are you stuck in FBI name check? You can call CIS and check the status.

Here is my situation. Have H1B expiring on June 2008. Planning to Renew. I-140 approved last Month. I485 applied and pending for more than 180 days. Have EAD, AP.
Now - I am planning to switch to another job for Title , Hike. Not happy with the current company.
I have the following question :
1) If I switch,what will happen to my I-485 / I-140. do I need to reapply ? . do I lost my priority date.
2) If I go to India, what will happen to My 485/140. Can I change AOS to consular processing.
Please advise.

If I'm not mistaken, PD is only linked to your I-140 receipt notice as it is specifically for labor authorization / certification.
As long as it shows on your I-140, you should be fine.

One of my friends is saying Job experience with the same company would not count towards? So this means will i have to change jobs and hope that my I-140 for the current employer is not withdrawn. Pl. advise.

The job experience from the same company can only be counted if the employer can prove the new job is atleast 50 % different from the current job. Please consult a lawyer before making the decision. The difference should be in job duties and not simply a move between two projects.

my wife is US citizen , applied for permanent residency (green card) almost 6 months back , my interview was 2 days back, everything went thru alrite, the immigration officer said at the end of interview , " your case been aproved, but we did not get the background chk from FBI , as soon as we get it we are going to mail you the green card "
is this normal? i checked "case status' on USCIS website, they still have some update from 4 months back ...

I have a friend who is stuck in background check for 2+ years (same situation, a spouse of a US citizen). Hope it won't happen to you! Not much you can do now, just wait. If you do not get any response within a year, consider suing the USCIS (that's what my friend is doing).

I'm sure the following questions have been asked several times too. What are the answers in the following scenarios:
After 485 filing and before 180 days:
- Person loses job and is unemployed. Does the 485 stage continue? Does AP and EAD assigned to this person still continue to work?
- If this person finds another job (based on EAD or H1), does the 485 process continue? Or does the whole GC process needs to restart?

It is very simple actually. It most likely will take an hour of your time. And will not cost any $$ to you.
You go to the tester with whom your new employer has a contract; tell them you came for a new employee drug test for so and so company; they will take your ID information and if they need a code from the company; they will take your sample and send you on your way.
They will send the results to your employer over the following few days.
Obviously if you don't do any drugs, you will be OK.
In case of a (false) negative, you will get a chance to challenge.

First of all congratulations to all those who got their approval in the last couple months. Now comes the big dilemma for some of us. Did anyone tried to switch their jobs, or at least, ditch their current employer? Did anyone switched their employer immediately after the green card approval? I am sailing in this boat. I want to switch my employer ASAP, but is hesitating to do so... as you know there are some obvious reasons later. What are other problems that you think other than getting tons of questions during the citizenship? Appreciate your answers. ;)
Just my opinion. Stay with employer for 6 months - 1 year. Stay in the same profession for atleast 2 years ( i understood that way from Attorney Ron Gotcher )

I & My wife are working on H1-B visas currently. We two simulataneously started our Greencard process with our employers.
Both of us have a priority date of Sept 2006 & our EB category is Eb2. Both our labors got approved & applied for I-140s. My wife's I-140 got approved recently (from TSC) while Mine is still pending with NSC (Nebraska dates are behind).
A couple of months back, my current employer offered me a pre-aproved EB3 labor (from April 2004) & asked me to apply for I-140 (Substitute). He told me that once approved, I can port this EB3 2004 priority date onto my Eb2 I140. I applied for the same in premium processing, subsequently got an ability-to-Pay RFE and employer is working on providing audited financial statements from 2004.
Overall, we have 3 I-140s between me (2 pending) & my wife (1 Approved). Now that everything is current which one should we pick for applying I-485....This has become a big puzzle for us.
Here below is a snapshot of our status:
Me - EB2 (Sept 2006) - I-140 Pending
- EB3 (Apr 2004) - I-140 Pending (got RFE)
My wife - EB2 (Sept 2006) - I-140 Approved
Here are the options we could think of -
I know, the safest way is to apply I-485 to my wife's approved I-140. But with the DHS's forecast that retrogression is going to be back anytime around Spetember of this year, I am not sure if applying 485 based on a year 2006's date is any useful!! (We get EAD but we may be struck for years to get the green cards).
Is there an option for both of us to apply for I-485s (I will be dependent on my wife's application & my wife would be dependent on my application). If possible, this option gives us a safety net & also helps us in picking up the best. I know at some point, we have to choose between either of the I-485s but hopefully in a couple of months, we get clarity when both my I-140s are approved.
Or is it possible for me to apply for AOS on my pending EB2 2006 I-140 and then once my other Eb3 I-140 is also approved, Can I port the PDs while my I-485 is pending??

Hi folks. My wife is petitioning for my green card and we are kind of stuck on a few questions. Hope someone can help us with some or all of these queries we have.

1. Part C q#10 - I arrived in the US in 2004 on an F1 visa. Now, I'm on H1B status. I don't believe I have ever been given an alien registration number. Am I wrong?
2. Part C q#14 - Do I say I arrived as a student even though I am currently on H1-B? If so, I don't have that I-94 anymore. It was taken by the airline when I left to get my H1-B stamped. Also, I have travelled extensively for work ever since I started my job. Consequently, I have two I94's. This is because I recently renewed my passport and when I went to Canada for business, upon returning they gave me a new I-94 (the previous I-94 is still in my old passport). So, what do i say i arrived as? And which I-94 number should I provide? Also, the format of the I-94 number on the top of the card seems to be different from that on the application ie. xxx-xxxxxxxx???
3. Part C q#19 and 20 - I don't really have any relatives in my home country anymore. Do I still have to give an address? Also, I can't write my name in my native language either. What do i do?
4. Part C q#22 - The instructions for I-485 say that if I am filing concurrently then I should mail everything to their lockbox address in Chicago. So, do I enter Chicago, IL here? or my current city, state of residence?

Your I-94 should be valid as long as your H1B is valid. If you applied for H1B extension they will give you new I94. It should be at the bottom of your 797, please check your H1B approval notice.

My wife and I were entered on AP lately and since I work for the same employer, I am still working on my H1 and am planning to extend my H1. My wife is working on EAD, can she still able to apply for H4 based on my H1? We want to have her H4 as a back-up!
