Depends on the availability of visa numbers at the time of applying for H1 extension...Had you applied for your H1 extension during July17 - Aug17 when dates were 'C'..you are right...you would have got a 1 year extension....
But if you are from a retrogessed country, then even though you have filed for I-485, there is no visa number available and hence you are eligible for 3 year extension...
I am assuming you are from either IN/CH/MX/PH and that your PD is not current...
This is only my interpretation...Kindly consult with a lawyer...

at this rate probably it will take them 20 years to show the actual status, instead of crappy catch-all 'initial review' state.

I never entered the US in the first place.
I believe you can enter as long as the visa does not expire. But make sure to check with your company lawyer.
Also make sure you have a real job/work when you enter.

Thank you, I looked through the blog but it didnt have any posts that could answer my queries. I am just trying to find out if it is ok to travel if I have a pending case with USCIS? Also, if my H4 goes out of status on 09/23/2010, then does that mean I have immediately leave the country? Any answers would help, thanks.

DHS Leadership Journal Has Just Posted the Following:
http://www.dhs.gov/xlibrary/graphics/open-share-gray.jpg (http://openhomelandsecurity.ideascale.com/)
In recent days, the Department of Homeland Security has taken a major step toward its priority to create a more open, transparent, efficient, and effective government. As part of President Obama's Open Government Directive, we have now launched the DHS Open Government Initiative (http://www.dhs.gov/open).
The Administration has set four goals for its Open Government effort, calling them the "cornerstone of an open government." The goals DHS will seek are:
improving transparency by providing more information and data about the Department's activities in a timely and accessible manner;
increasing participation by utilizing new tools and strategies to encourage input and feedback from the public;
expanding collaboration with our many partners, both inside and outside government; and
encouraging innovation to find new ways to make the government more open and efficient and save taxpayers money.
The Department of Homeland Security wants your input on our Open Government Plan. How should we increase our transparency to the public? What is the best way to foster a culture of participation? Do you have ideas to help increase collaboration? We want to hear your thoughts and ideas.
The online participation tool (http://openhomelandsecurity.ideascale.com/) will be available until March 19, 2010. You can contribute your own ideas and rate idea others have submitted.

Hi,
My I-485 AOS thru my Husband's I-140 is pending right now.
Recently My sister's Approved I-130's priority date is Current, So now I Can file for AOS thru my Sister's I-130 also.
My question is :
Which is better Interfile or new filling ?
What are the advantages and dis-advantages of both ?
If I go for Interfiling and If My Application is not approved thur one track (I-130 / I-140) will my application be pending for another track ?
Thanks
Immqry

What the denial notice says? Your options are to file a new H-1B ... in the meantime please appeal the case immediately as this will buy time.
Regarding other options, you can either re-enter US on B-1 or visit a consulate and get H-4 stamped.

I do not know about I485...
but it is not hard to get copies of W2. IRS has a service that will give you copies of your fed tax papers including W2s in 60 days. You can also ask you employer, they ususlay keep a copy.

Hi,
My H1 transfer got denied. My company said they are unlikely to file an MTR. I have a valid EAD and old company H1 (based on 140 approval) valid till Jan 2010.
Can i find other company and file a different H1 transfer based on my old company valid H1?
Please Advice.
Hi Vikram -
Since your H-1B transfer petition is denied, you are not in H1 status anymore. However, I would suggest consider applying for 3 year H1 based on approved I-140 (and PD is not current). It does not matter who applied for that I-140.
There is a chance that USCIS may approve this H1 without I-94. In that case, you need to get new visa stamp and reenter into US to get back into H-1B status.
Good Luck.

You can try but they recommend going to your own country for stamping if there is a change in status (H1 to F1 or vice versa). If you to Mexico, please have a plan B.
